Online Shop Terms of Use

These Terms of Use (hereinafter referred to as "the Terms") stipulate the terms of use of the online shop (hereinafter referred to as "the Service") provided on this website by Yokohama Winery Co., Ltd. Article 2 (User Registration)

Article 3 (Management of User ID and Password)

1. Users shall manage their user IDs and passwords for this service at their own responsibility.

If the User ID and password combination matches the registered information and is used to log in, the Company will consider that the User ID is being used by the User who registered the User ID.
3. We shall not be liable for any damages caused by a third party using your user ID and password, except in cases where we are guilty of intentional or gross negligence.

Article 4 (Sales Contract)

1. In this service, a sales contract is established when the user makes a purchase application to our company and our company notifies the user that the application has been accepted. The ownership of the product is transferred to the user when our company delivers the product to the delivery company.
2. If the User falls under any of the following circumstances, the Company may cancel the sales contract under the preceding paragraph without prior notice to the User.

5. Any other case where we deem that the trust between our company and the user has been damaged.

Article 5 (Intellectual Property Rights)

The copyright or other intellectual property rights of the product photos and other content (hereinafter referred to as "Content") provided by this Service belong to the legitimate rights holders , such as our company and the content providers , and Users may not reproduce , reprint , modify , or make any other secondary use of the Content without permission .

Article 6 (Prohibitions)

When using this service, users must not engage in the following acts.

Article 8 (Restrictions on Use and Cancellation of Registration)

Article 9 (Withdrawal)

Users may cancel their membership to this service by following the designated cancellation procedure.

Article 10 (Disclaimer of Warranties and Disclaimers)

1. The Company does not guarantee that the Service is free from factual or legal defects (including defects regarding safety , reliability , accuracy , completeness , validity , suitability for a particular purpose , security, etc. , errors and bugs , infringement of rights, etc.).
2. The Company shall not be liable for any damages incurred by the User as a result of the Service. However , if the contract between the Company and the User regarding the Service (including these Terms) is a consumer contract as defined in the Consumer Contract Act , this disclaimer shall not apply . Even in this case , the Company shall not be liable for any damages incurred by the User due to special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of the damages) caused by default or tort due to the Company's negligence ( excluding gross negligence).
3. The Company shall not be liable for any transactions, communications, disputes, etc. that arise between a user and another user or a third party in relation to the Service.

Article 11 (Changes to Service Content, etc.)

The Company reserves the right to change the content of the Service or to discontinue provision of the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result thereof.

Article 12 (Changes to Terms of Use)

Our company reserves the right to change these terms at any time without notifying the user if it deems it necessary. In addition, if a user starts using the service after these terms have been changed, the user will be deemed to have agreed to the changed terms.

Article 13 (Handling of Personal Information)

Article 14 (Notice or Contact)

Any notification or communication between the User and the Company shall be made in accordance with the method specified by the Company. Unless the User notifies the Company of any changes in accordance with the method separately specified by the Company , the Company shall consider the currently registered contact information to be valid and shall notify or contact the User via said contact information , and such notification or communication shall be deemed to have reached the User at the time of sending.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or pledge as security to a third party their status under the Service Agreement or their rights or obligations under these Terms and Conditions without our prior written consent.

Article 16 (Governing Law and Jurisdiction)

1. The interpretation of these Terms shall be governed by the laws of Japan. The application of the United Nations Convention on Contracts for the International Sale of Goods to this Service shall be excluded.
2. In the event of a dispute regarding the Service, the court with jurisdiction over our head office location shall be the court of exclusive jurisdiction.
